Phillip F. Fargotstein

During his illustrious career as an environmental attorney, Phil Fargotstein has counseled a variety of clients, including large electricity generating facilities, cement manufacturers, natural gas distribution facilities, smelters, mines and manufacturing facilities in almost every aspect of environmental law. He represents industrial clients on environmental air quality compliance, transactions and permitting, and enforcement issues and appeals.

As an environmental litigator, Phil relishes the challenge of comprehending massive amounts of information compiled during the discovery process, and then, communicating this material in a compelling way to the fact finder on behalf of his clients. Needless to say, Phil is often the one who gets the call to defend business and property owners on underground storage tanks, hazard waste issues, air quality, and the Clean Water Act enforcement actions and cost recovery actions under state and federal Superfund statutes. While serving in the Marine Corps artillery in California, Phil aspired to become a judge advocate. This fateful decision led Phil to study at Harvard Law School, and to a career as a civil litigation attorney. Phil’s passion for environmental law began in the 1970s, when he served as a law specialist for the Marines base. Today, the retired colonel advises clients on climate change issues, and develops federal and regulatory programs to address climate change.

Outside of his work as an environmental attorney, Phil is married and his two adult children are his pride and joy – one in San Francisco involved in international business, and one living in D.C., following in her father’s footsteps as an attorney. His motorcycle days have been replaced with long hikes through the wilds of Arizona, and he knows his way around a shooting range, where the focus of putting holes through a paper target puts his active brain in a different place.
