The second presentation is on Friday, February 15, 2013 from 9:00 am to 12:15 pm at the Bar Association of San Francisco, Conference Room A, 301 Battery Street, 3rd Floor, San Francisco.

3 hours of MCLE credit will be offered.

Program Description:

Estate planning for same-sex partners, whether unmarried, married, or in a civil union, can raise new and different issues than those involving single persons or opposite-sex couples. Without appropriate estate planning documents, a surviving partner in an LGBT relationship may not be provided for and may not be able to carry out the incapacitated or deceased partner’s wishes. In addition, a plan may need to provide for children or other beneficiaries, take into account contractual obligations, and protect existing assets.

Estate planning attorneys who wish to practice in this area will learn:

  • Ethical issues in representing partners
  • Characterization of assets
  • Developing an estate plan
  • Powers of attorney
  • Nonprobate transfers of property
  • Providing for children
  • Revocable trusts
  • Using GRATs, GRUTs and QPRTs
  • Debts
  • Strategies for minimizing gift or estate taxes
  • Employee benefits
  • Special drafting considerations
