Maggie DiCostanzo

Maggie DiCostanzo is a Director in Fennemore’s Business & Finance Group, where she brings more than two decades of experience guiding clients through the complex world of health care and intellectual property law.

Maggie is a trusted advisor to physicians, hospitals, post-acute care facilities, and other healthcare providers, helping them navigate regulatory compliance, administrative challenges, professional liability, and transactions such as the purchase and sale of medical entities. She also works collaboratively with other members of Fennmore in employment matters, corporate matters, and intellectual property matters. As a registered patent attorney with the U.S. Patent & Trademark Office, she also helps clients protect their innovations – from drafting licensing agreements to advising on trademarks and intellectual property strategy.

A dynamic speaker and author, Maggie has written extensively and presented to healthcare professionals nationwide on pressing issues like HIPAA compliance, telemedicine, reducing professional liability, and post-adverse event communication. Her thought leadership helped shape Pennsylvania’s Benevolent Gesture Liability Act, giving healthcare professionals the ability to express compassion to patients and families without fear of legal repercussions.

Beyond her practice, Maggie has shared her knowledge as an adjunct professor at Penn State University, York campus, teaching continuing education students about assisted living and personal home care facility regulations. She is also deeply committed to service: volunteering as a juror for the Pennsylvania Bar Association’s Mock Trial Program and providing pro bono support to Afghan asylum seekers and pardon project participants. She also volunteers with a local community cat rescue and foster program.

Whether she is advising a hospital system, safeguarding a new medical device innovation, or mentoring the next generation of legal professionals, Magiie brings both legal precision and a passion for problem-solving to every client relationship.

  • Represented the purchaser of six (6) senior living facilities in Pennsylvania.
  • Negotiated settlement of Medicaid fraud allegations against a dentist.
  • Represented therapists in federal healthcare reimbursement program appeals.
  • Represented physicians before the state board of medicine in disciplinary proceedings.
  • Negotiated joint venture agreement documents for a Pennsylvania practice involving multiple dialysis centers.
  • Represented a multi-practice pain management group in health benefit reimbursement appeals.
  • Represented healthcare providers involved in HIPAA data breaches and supported their initial investigations and reporting.
  • Drafted vendor contract agreements for a hospital system, including a Master Vendor Purchase Agreement, consignment agreements, evaluation agreements, affiliation agreements, MOUs, clinical affiliation agreements, non-disclosure agreements and independent contractor agreements to standardize agreements throughout the system.
