2018 California Construction Law Update
During the first year of the 2017-2018 Legislative Session, while much political attention was focused on several California laws that could be viewed as California’s rebuke of Washington, including California’s legalization of marijuana, enactment of “sanctuary state” legislation, and bills focused on climate change, 2017 also saw the enactment of a package of bills intended to address the state’s housing affordability crises, as well as a range of other bills of interest to the construction industry.

The U.S. construction industry is in a “mature stage of expansion,” according to industry experts, with deceleration predicted in certain industry segments and continued but modest growth in others, for 2018.
New California Law Makes Direct Contractors Liable for Wage Violations of their Subcontractors
If there’s one law from the 2017 Legislative Session that has garnered a lot of attention in the construction press, it’s AB 1701. Under AB 1701, for contracts entered into on or after January 1, 2018, direct contractors may be found liable for unpaid wages, fringe or other benefit payments, or contributions owed by a subcontractor of any tier to their workers.
An Overview of California’s Prompt Payment Laws
California’s prompt payment laws are scattered throughout the state’s Business and Professions Code, Public Contracts Code and Civil Code. Their applicability varies depending on the type of project, the type of payment (progress payment or retention), and who is paying (owner, public entity or direct contractor). In short, it can be darn confusing.
