Wendel Rosen Attorneys Examine Court Decision on Disinherited Trust Beneficiaries

In their byline article for the Daily Journal, Partner Kevin Rodriguez and his associate examine the California Supreme Court’s recent Barefoot v. Jennings decision. The court held that previously named trust beneficiaries who were disinherited because of an amendment have standing to challenge that amendment.

Kevin and his team review the various differing lower court decisions and what led to the Supreme Court’s decision to reverse the appellate court decision. They explain that the court was “careful to limit its decision to disinherited beneficiaries,” refusing to determine whether “an heir who was never a trust beneficiary has standing to challenge a trust.
